Bank of America‘s Mortgage Sale and Your Short Sale

Last week Bank of America (BofA) announced the sale of collection rights to over $300 billion worth of residential mortgages. The mortgages were sold to Nationstar Mortgage Holdings and Walter Investment Management (two of the most prolific buyers these days, along with Ocwen Financial Corporation). BofA is expected to unload another $100 billion in mortgages in the coming weeks.

What does this mean to us? Let your clients know that if they receive a notice that their mortgage has been sold, to contact you immediately.

You will then want to monitor correspondence exchanged between your clients and the financial institution, so that the process continues to be expedited.

Don’t panic, because sometimes the process actually improves when the loan is sold (fresh eyes on the case). But do make sure to keep your eyes on it as well.

Mortgage Regulations Decided

Last week, the Consumer Financial Protection Bureau (CFPB) created some new guidelines for mortgage lending. They will go into effect January 2014.

The CFPB was influenced by claims from many distressed borrowers that lenders approved loans which they knew the borrower would not be able to repay.

Without weighing you down with too much detail, below are two critical pieces of the new regulations.

  1. Qualified Mortgage (QM) Rule
    Simply put, The QM provides protection to both borrower and lender. It will include:

    - Limits on interest rates, points and fees
    - Ban on certain loan features (such as loan terms of longer than 30 years, interest-only payments, balloon payments, negative amortization, etc.)
  2. Ability to Repay Rule
    This rule, which is part of the QM, states that all new mortgages comply with basic requirements to protect consumers from taking on loans they can’t repay.

    Provisions include a maximum limit on monthly debt-to-income ratios, and a borrower’s ability to repay the debt over the life of the loan. Many self-employed and commission earning borrowers will be effected.

    Under the new rule, a borrower's total monthly debt, including mortgage payments and associated costs such as property taxes and homeowner's insurance, cannot exceed 43 percent of monthly income in order for the loan to be considered ‘qualified’.

Silver Lining:

What didn’t get written into the rule (which many had feared) are requirements for minimum down payments for qualified mortgages.
